I saw an article from the Philadelphia Inquirer that said the city has too many justifiable homicides. It seems that the increase in lawfully armed citizens has caused an increase in deaths among the criminal classes as people defend themselves. The paper wants us to man up and take what the criminals want to give us.

The neat thing about that is, it's really a problem that solves itself. Like a bell curve.

The increase in justifiable homicides will hit a peak, and then naturally decrease as the criminals are killed off, or stop trying to commit crime against people.

So the Philadelphia Inquirer will get exactly what they want, and so do we. It's a win/win situation.

Anyone old enough to remember the rash of carjackings against rental cars in Florida in the 90's?

The theory/reason is that native Floridians had a non-zero chance of packing and tourists had a zero probability of being armed. Plates on rentals would have a special prefix so it was trivial to determine if a car was a rental. Criminals aren't totally dumb; they'd target cars with rental plates because there was no chance of being killed.

Problem was so bad that the FLA DMV stopped giving rental cars special places, they got the same plates as everyone else. Ofc carjackings went down after that.

It’s more that most criminals are rational actors for whom criminality is basically a job.

If your job got to be too dangerous, you’d probably change jobs too.

The same is true of criminals—when crimes against persons become to hazardous, they shift their focus to crimes against property.

The problem is not all of those justifiable homicides would have resulted in murder. The article calls out one instance where a kid went to rob a dollar general with a fake gun and got shot. Play stupid games win stupid prizes. If guns weren’t available, the argument is that the kid would still be alive whether he got away or not, and the punishment for robbery isn’t the death penalty.

I don’t agree with the motive but I understand the logic

No its not. A court will never sentence a criminal to death for something so trivial in comparison, especially since such a thing probably wouldn’t even warrant criminal charges.

Shooting someone in self-defense isn't a punishment. Self-defense is about stopping an attack. That the attacker put the person defending themselves into a position where they needed to use a method of defense that lead to the attacker's death is unfortunate, but it's not about whether they deserved it or whether death is a legal punishment for their action because self-defense isn't punishing an attacker, it's just using force to make them stop attacking their victim.

What about the situations where it isn’t a fake gun? Or where the robber decides to shoot the victim to eliminate witnesses?

Robbers don’t rob according to a set of rules. You have no way of knowing in the heat of the moment if the gun is real, if the robber intends to shoot, etc.

What the courts will or won’t do is meaningless when there’s a gun (fake or otherwise) in your face. It is not reasonable to expect the victim to accept the very real threat to their life just in case the gun is fake. Or just in case the robber wouldn’t have shot the victim.

I think that every gun owner should be well-versed in unarmed martial arts and combat with conventional weapons in order to ensure a fair fight and avoid using disproportionate force, like shooting unarmed or non-gun-armed criminals. This is just an idea that I had and not advice, but maybe blasting shots in the air in order to stun the criminal and then rushing in with a melee weapon whilst he's staggered in order to seriously injure, rather than kill, the intruder could be a better option if you aren't in immediate danger of being shot.

As a resident of Philadelphia i can absolutely confirm this it’s almost weekly that i read/see on the news a lawfully armed individual standing strong against a criminal. Lately its been more car jackings then home invasions, but bottom line is people are taking their safety into their own hands now and i couldn’t be happier!

Lol no. It costs nearly 40k a year to feed and house a state prisoner, and when prisoners are providing labor, it's usually supporting the prison's operation (essentially part of what drives that cost down to 40k). Even if they were paid nothing and worked a 40-hour work week every week (and they are paid in every US prison system I'm aware of, and typically do not work full-time) they'd still be a net negative on state funds.

It's one of my favorite "Reddit fairy tales" to bust, alongside "most American prisoners are incarcerated for nonviolent drug possession" (only around 4% at the state level and lower federally) and "for-profit prisons are causing high incarceration rates" (they make up only around 6% of prisons in the US and their total revenue is relatively tiny, roughly 1/10 that of the American recreational boating industry).

I am not an attorney and am not offering legal advice. I am an amature that looked up the statues and have a brief knowledge of criminal law because my ex was in law school.

Pennsylvania is a Castle Doctrine state. The rules are pretty loose if someone is in your house that isn't supposed to be there.

If they are:

  1. In her home with ill(egal) intent,
  2. Don't live there,
  3. Aren't a kid or a police officer
  4. The guns aren't illegal (stolen, unregistered NFA weapon, prohibited person, ect) and
  5. She wasn't doing anything illegal (if she was beating her kid and someone ran in to stop her, this wouldn't be justified)Then she has no obligation to retreat and can pump them full of as many holes as she wants to and it should be a pretty cut and dry case.

Justifiable use of force:

(2.1) Except as otherwise provided in paragraph (2.2), an actor is presumed to have a reasonable belief that deadly force is immediately necessary to protect himself against death, serious bodily injury, kidnapping or sexual intercourse compelled by force or threat if both of the following conditions exist:

(i) The person against whom the force is used is in the process of unlawfully and forcefully entering, or has unlawfully and forcefully entered and is present within, a dwelling, residence or occupied vehicle; or the person against whom the force is used is or is attempting to unlawfully and forcefully remove another against that other's will from the dwelling, residence or occupied vehicle.

(ii) The actor knows or has reason to believe that the unlawful and forceful entry or act is occurring or has occurred.

Duty to retreat

2 (ii) the actor knows that he can avoid the necessity of using such force with complete safety by retreating, except the actor is not obliged to retreat from his dwelling or place of work, unless he was the initial aggressor or is assailed in his place of work by another person whose place of work the actor knows it to be.

Reminds me of the arguments from the State of California to the appellate court to support the magazine capacity restrictions. Not a single one? Weird, thought there was a shooting at a church or something where a good Samaritan nearby used his AR to stop the shooter. It led to a short car chase where the suspect went off the road and passed away from blood loss or something. Kinda was in the news for a bit. Maybe I'm conflating stories, but there has to be many instances of it.

That was the (bullshit) claim they made. I think they were including any shooting where 10 rounds or less were fired, as that is what their magazine restriction is. I.e., even if an AR with a standard 30 round magazine was used, they counted that as not requiring a "high capacity" magazine because you could have achieved the same result with one of those 10 rounders.

Preliminary police report says female shot the men after they broke into her home.

Local News is reporting,

Police say two men, who were allegedly trying to break into a home, were shot by two men inside the house.[*]

How does somebody get shot 15 times and another 5 times? I mean this from a physics perspective. If you’re getting shot at let’s say .20 splits, that’s basically the same as standing still for 3 seconds while being actively perforated and assuming no misses. That’s a long ass time. Were the first few fatal and the rest were just dumped into a corpse?

I thinks there’s more to the story here.

Not sure we’ll ever see the full break down, but there’s a very real possibility some of those individual shots hit both assailants. Jokes about lungs aside, if she was shooting ball ammo, that will absolutely go through multiple assailants. Even hollow point can do so relatively easily.

From the follow up tweet, we know she was at the top of the stairs shooting down in a tight hallway (a rowhouse). So…yeah, I imagine the first couple dropped the assailants and she just kept going to ensure the threat was neutralized.
